Indeed the problem was I was using "keep together" as the formatting for my auto-title. I made the copy as you suggested and went to Insert -> Auto-Title -> Edit Title Flows and applied the new paragraph style to the TOC tab for the auto-title that was giving me problems.

When I go to create my TOC the formating is coming out fine for my chapter headings but when it tries to format some of the sub headings and figures it is inserting a page break after each of these entries, so I end up with a TOC that is about 100 pages long.
