I might not be the greatest expert with Mellel but, for my experience, there is no way to preserve the list levels. The problem seems to have been with Bookends (although they told me it was with Mellel). Their latest release seems to have fixed it.

I can find the paragraphs without any problem – it's the replacing them with nothing part where I get confused. (and I am easily confused)
